Is it possible to get a passport without having a residence permit?

A passport is needed for the possibility of a foreigner crossing another state. The algorithm for obtaining international passports is regulated by the Administrative Code and the regulations of the FMS. In real life, many have encountered a problem when, in the presence of temporary registration, the local branch of the FMS refuses to issue an exit document. According to the law, such actions are illegal and can be appealed.

Algorithm for obtaining a passport in the FMS

Today, all the powers to issue and issue passports belong to the FMS (Federal Migration Service).

There are two ways to get a passport without a residence permit:

  1. Submit an application in person to the territorial office of the FMS at the place of residence.
  2. . Regardless of the location in Moscow and other regions, it is possible to issue a passport through the State Services portal.
Important! For issuing a passport online, a smaller fee is charged than when applying in person.

Like it or not, the FMS office must be visited several times. First you need to get advice about registration (you can find out everything by phone). Next, you need to submit a package of papers for consideration. The last step is to get the passport itself. If the application was submitted online, then you also need to pick up the document at the FMS.

Where to go if there is no permanent registration

According to the Administrative Regulations (paragraph 4), approved by the FMS Order No. 26, dated February 3, 2010, any citizen of the Russian Federation has the right to apply for a passport without having permanent registration at the actual place of residence. If you do not have either permanent or temporary residence registration, the application must still be accepted.

In Moscow and the Moscow Region, these rules are also valid. It is enough to contact one of the regional offices in Moscow or another region, you will simply have to be received and advised. It is possible that you will be redirected to another department of the FMS within the city, this is due to the fact that the acceptance of documents of citizens with no permanent registration is served by another department.

The presence of a temporary residence permit in Moscow or the regions also cannot become an obstacle to filing papers. For example, you have been living in Moscow for more than 5 years, but are registered in Yaroslavl, in this case you can safely go to the FMS department in the area where you actually live.

Important! According to the administrative regulations, the period for issuing a passport is 1 month, if the applicant has a permanent residence permit in the region where the documents are submitted. In the case of non-residents, the issuance period will be up to 4 months. Practice shows that a passport without a residence permit is made no longer than a month.

In cases where the issuance of documents is denied due to the lack of registration, then you need to complain to the authorities of this migration service. If the complaint does not bring results, then it is necessary to go to court.


The deadlines for registration are necessary for a comprehensive check of the client's data, the presence of a criminal record is checked, whether there are debts in banks or debts on alimony, etc. Exceptions when the registration process can be accelerated are emergency situations (for example, a person needs an urgent operation), etc.

Refusal is lawful only when a citizen cannot be issued a passport at all. For example, if a person has a criminal record for a serious crime or is under investigation.

Documents required for obtaining a passport

The FMS must submit:

  • Russian passport (original and copies);
  • the child needs to present a birth certificate and his passport (for children from 14 years old);
  • men need to present a military ID;
  • 4 photos for documents (3*4 cm);
  • application form for obtaining a document;
  • a copy of the work book, if not, then this must be notified in advance. In the column "Employment" they will indicate that the information is indicated from the words of the applicant;
  • pensioners need to present a pension;
  • old passport (if the document is reissued);
  • receipt for payment of state duty.

If a person had a criminal record or was under investigation, certificates are needed stating that the person has served his sentence and is not being prosecuted by law enforcement agencies.
