How to get a TRP in Russia for citizens of Ukraine

With the change in the migration law, the situation with staying in the Russian Federation has become more complicated for the majority of Ukrainians, and therefore we will try to figure out how and in what order the TRP is provided for citizens of Ukraine in 2017. Against the background of the economic and political instability in Ukraine that has persisted in recent years, Russia receives a constant flow of migrants from different regions of this country. Someone is looking for a place where they can survive hard times away from their homeland, while others want to stay in Russia altogether, becoming its citizens.

Changes in migration legislation and TRP for Ukrainians

There is a misconception that it is possible to obtain a TRP for citizens of Ukraine in 2017 in a simplified manner. In fact, it doesn't exist as such. All the same rules of law apply to visitors from this state as to other migrants. Moreover, the new law in 2015 amended and deprived the majority of Ukrainians of the right to baselessly and permanently extend their stay in Russia. Initially, a visa-free stay in the Russian Federation was allowed for 90 days continuously. It was enough just to cross the border again and get a new migration card or renew the registration.

Now the situation has changed significantly and residents of most regions of this state can stay in the Russian Federation for no more than 90 days within six months. An exception is made only for residents of the Donetsk and Luhansk People's Republics, whose citizens, being in a difficult situation, seek to leave the troubled regions.

As for the process of obtaining a TRP itself, it is the same as for visitors from most other states of the post-Soviet space.

What is RVP, who needs it and what gives

TRP - a temporary residence permit for citizens of Ukraine - is a document that gives a citizen of Ukraine the right to legally reside on the territory of the Russian Federation for 3 years. Any Ukrainian who lives and plans to stay in Russia for more than 90 days within six months must contact the local branch of the Federal Migration Service no later than a week before the expiration of the three-month stay and apply for a TRP. The law gives the right to move freely throughout the territory of the Russian Federation under the TRP, but must reside in the region where it was registered. The person who received it has the right to use medical services, having issued a compulsory medical insurance policy, to study in educational institutions on an equal basis with citizens of the Russian Federation. To work, you will need to additionally apply for a patent.

Some residents of Ukraine are sure that they are not subject to the rule of quoting the number of permits in the regions of the country. This is wrong. The number of quotas for the reception of foreigners for temporary residence in each region of the country is distributed annually. At the same time, it should be taken into account that they are not equal for all regions and change every year depending on the needs and possibilities of the region to accept foreign labor. This must be taken into account for those who do not have a privileged right to receive a temporary residence permit in Russia without taking into account quotas. For example, in the European part of Russia, summer is the time for the distribution of the last permits, and beyond the Urals, you can get it a little later.

Attention! Registration of RVP usually takes no more than 2 months.

TRP outside the quota

But before you worry about quotas and urgently pack your bags, you need to make sure that you have no reason to get a permit without quotas. The law gives you the right to bypass the quota if you:

  1. previously had USSR citizenship;
  2. have reached the age of majority, but are incapacitated or limited in capacity;
  3. have not reached the age of 18, and the application was made by the parents, or you receive it together with the parents;
  4. entered into a legal marriage with a citizen of the Russian Federation;
  5. participate in the program of resettlement of compatriots;
  6. you are a parent of a citizen of the Russian Federation;
  7. serve in the Russian army;
  8. you have a parent who is a retired citizen of Russia;
  9. disabled, but have able-bodied children of citizens of the Russian Federation.

In all other cases, the law obliges to receive TRP in the order of quotas established for 2017.

Documentation

So how do you get a RVP? To do this, you need to come to the FMS department at the place of registration with a full package of documents. It is not too large, but the collection requires some attention. Firstly, some documents have an expiration date, and secondly, some of them will have to be paid. Going to the FMS office you need to have with you:

  • Two copies of the RVP application. Of course, it is fashionable to get it on the spot and fill it out there, but not all departments have samples, and the lines to the necessary offices are simply huge and it’s difficult to go out to fill out the form, and then it’s difficult to stand again. It is much easier to download the form and fill out the sample online and fill it out at home on your computer. All information is entered in Russian, except for the last name, first name and patronymic. They are also entered in Latin as written in the passport. When filling out, you cannot correct anything or use abbreviations - abbreviations. If the information does not fit in some section, then take an additional sheet, write your last name, first name and patronymic and enter the required data.
  • Ukrainian passport and its notarized translation into Russian.
  • Two photographs 35 by 45 mm. They can be in color or black and white. The main thing is that they are of high quality and not subjected to retouching. The applicant is filmed full face with a calm expression on his face. Of the accessories, only optical glasses with transparent lenses, an eye patch if it is worn permanently for medical reasons, and religious headdresses that do not cover the face are allowed.
  • Certificate of absence of criminal prosecution and outstanding conviction in Ukraine. It is valid for six months from the date of issue.
  • Certificate stating that the applicant does not suffer from alcohol, drug addiction, mental illness, socially dangerous or quarantine diseases: HIV, tuberculosis, syphilis. It doesn't make sense to get them in Ukraine. The FMS will only accept a certificate issued by accredited medical institutions in the region. It is fashionable to find out their addresses on the websites of the migration service or by phone. The survey is carried out on a commercial basis. The certificate is valid for 3 months from the date of issue.
  • Receipt of payment of state duty.
  • Russian language proficiency certificate. The law makes exceptions regarding his representation for minors, incapacitated, disabled and highly qualified professionals. To obtain such a certificate, you will have to pass an exam in specially open centers. They work in almost every region of the country, on the basis of the largest educational institutions. The cost of the exam is 5300r. The number of retakes in case of failure is not limited.
  • Migration card.

If you apply for a permit bypassing the quota, you will have to prove your rights. In particular, submit documents confirming family relations with the Russian borders, service in the army, confirmation of former citizenship of the USSR, birth in the territory of the Russian Federation or the RSFRS, or a marriage certificate with a Russian.
