Obtaining a temporary residence permit through marriage to a Russian citizen

Today, many are interested in obtaining temporary residence permits in different ways. For some, there are state quotas, while others are trying to get around these paths and have benefits in the form of documents provided. In fact, this is not very simple, because only certain categories of persons, designated by the legislation of the Russian Federation, can receive benefits. Among the lucky ones who can receive a temporary residence permit without a quota are those persons who are legally married to a citizen of the Russian Federation. But for this it is necessary to collect a list of relevant documents.

Obtaining a temporary residence permit in connection with marriage is perhaps the easiest way to obtain a TRP for all quotas. The basis is the international legal principle of family unity.

Thus, documents that confirm legal marriage can speed up. Naturally, in the future it will develop into a residence permit, and then into citizenship - with the correct organization of the submission of documents.

Conditions for marriage

The marriage of a Russian citizen and a foreign resident does not provide for strict conditions for its registration. You can get married both on the territory of the Russian Federation and abroad - this will not affect the possibility of obtaining a temporary residence permit in Russia. The legislation implies that the reason for obtaining a TRP for a foreign citizen is the desire to start a family and live on the territory of the Russian Federation. However, there are a number of nuances that you should know when getting married:

  • The requirements of both states for marriage must be observed. Basically this is the age of marriage, written consent of the parents. If the current rules of one country are violated, the marriage cannot be considered legal in that territory;
  • if the marriage took place in another country, then this document must be marked with legalization;
  • if the marriage takes place on the territory of the Russian Federation, then the foreign citizen must have a document indicating that this person is not married abroad. This certificate is valid for 3 months, after which it must be issued again.
  • if the marriage was performed according to a religious rite or a unique ritual, bypassing the registration in the registry office, then such a marriage has no legal basis to be considered valid on the territory of the Russian Federation.

Deadline for receiving a temporary residence permit

The time frame for obtaining a temporary residence permit may also vary; as a rule, this procedure takes from two to six months. Accordingly, if an applicant wishes to apply for a temporary residence permit from a visa-free country, the period is 2 months, and if the applicant is from a visa country, then up to 6 months. This is due to a more thorough verification of documents. There are cases when a temporary residence permit is issued earlier than the specified period; this may be due to the wife’s pregnancy. It happened and they gave it out in one day. The main thing is to clearly indicate in the documents the reason for obtaining this permission; in our case, it is the desire to reunite and live with the family.

In order to obtain a temporary residence permit for marriage, you need three components of documents:
  • Official marriage with a citizen of the Russian Federation
  • Documents confirming this: certificate, photocopies of passport pages, etc.
  • Permanent registration in Russia, that is, registration with the husband/wife of a representative of the Russian Federation.
