Foreign passports and documents

How is a patent readiness check done via the Internet

Citizens of other states who arrived in Russia in search of work, first of all, should take care of acquiring a legal status. Otherwise, they will not be able to officially find a job, since attracting foreign migrants without a work patent threatens employers with serious fines. It is quite simple to issue this document, but not many people know how to check the readiness of a patent so that they can get it in their hands, how to do it via the Internet, in what time it is made.

To begin with, let's figure out which categories of migrants are required for further official employment. Here you need to rely on the provisions prescribed in the law "On the legal status of foreign citizens in the Russian Federation" dated July 25, 2002 No. 115-FZ. There are the following conditions.

  1. Migrants who arrived without a visa (Tajiks, Uzbeks, Kyrgyz, Moldovans) are required to have a work permit.
  2. The purpose of arrival in the country indicated in the migration card (filled in when crossing the border) is “Employment” (or “Work”).
  3. A migrant who wishes to obtain a patent for work must be of legal age.

Immigrants with visas receive another document - a work permit. A separate group includes those categories of foreigners who can work under special conditions without a patent. These are, for example, diplomatic employees, foreign journalists, exchange students, highly qualified specialists, refugees, migrants, citizens of the Republics of Belarus and Kazakhstan.

If a migrant came to the Russian Federation in order to find a job, it is better for him to immediately apply for a patent, because there is a time frame for this: no more than 30 days. If earlier one had to apply for a patent for work to the FMS (its functions were transferred to the Main Department of Internal Affairs of the Ministry of Internal Affairs of the Russian Federation), now, in addition to this structure, special Multifunctional Migration Centers (MMCs) have been created for this in large cities of Russia, where they leave applications for a patent, presenting a passport and migration card.

On the website of any WMC, you can get information about related services for migrants (passing a medical examination, translation of a passport, a test in Russian), as well as find out the status of a patent. Granted patents vary in duration. The maximum duration does not exceed a year, the minimum period is a month, so it can be renewed 11 times in a row, after which a new patent will have to be issued. is done upon payment of personal income tax by the migrant (advance payment). Late payment of a patent leads to suspension of its validity.

Production time

Since the WMC is an intermediary between the migrant and the territorial UVM, the time for preparing a patent for a work can be from 10 to 20 days. Although the law clearly establishes a ten-day period. A slight delay in the time of issuing a patent is due to the fact that the documents received from the migrant in the UVM undergo a rigorous check.

Employees of the department must verify their authenticity, find out if a foreigner is not prohibited from entering Russia. In addition, a long period of time may take the passage of a mandatory medical examination, because of this, a migrant can receive a ready-made patent for work 20 or even 30 days after filing an application.

Ways to check readiness

Any migrant can't wait to pick up their patent so they can get to work. Hence the interest in how to know if a patent is ready or not. In what ways can this be done? You can check the readiness of a patent:

  • visiting the IMC in person after 10 days after the first visit;
  • after waiting for SMS about readiness / refusal to issue a patent;
  • by visiting the website of the WMC or GUVM.

Let us dwell in more detail on each of these methods for checking the readiness of a patent.

Waiting for SMS

The SMS alert service is very convenient for migrants who are looking forward to their work patent. Therefore, when making an application, it is necessary to indicate the contact phone number. After the patent for the work is made, a corresponding notification will be sent to this number. The text will contain information about the decision (positive or negative). Usually SMS comes after 10 days of waiting. If there is no response longer than the specified period, it is necessary, first of all, to independently check the readiness of the patent in another way: on the Internet or during a personal visit to the UVM or WMC.

Personal visit

You can check the status of a patent for a work directly on the spot. This is not very convenient, as it takes time, you can only arrive during the working hours of the Migration Center or the UVM (depending on where the documents were submitted). It is not a fact that upon arrival a foreigner will be issued a ready-made patent, since it may not be ready yet, especially if a person arrives ahead of schedule. Therefore, it makes sense to make a second visit when more than 10 days have passed since the application was submitted, and SMS has not yet arrived.

Through the website of the Migration Center

There are also convenient electronic services that allow you to check the readiness of a patent for work in Moscow and another region, where you can find out the readiness status of a document remotely.

There will also be information regarding the payment of the patent and what documents you need to provide in order to pick it up.

It is important to note that the effect of a patent applies exclusively to work in the subject of the Federation where the migrant received it. Therefore, if he is going to find a job in some other city, he will have to issue a new permit document.

Through the website of the GUVM of the Ministry of Internal Affairs of the Russian Federation

You should not try to check the readiness of a patent on the official website of the FMS of Moscow, this is impossible, since such a structure no longer exists. However, there is not a similar service, but not for checking the readiness, but for checking the validity of this document. It can be used both by employers to make sure that they are hiring a legal migrant, and by migrants themselves. Step by step instructions below.

Well, when after that information appears that a patent with such data is listed in the database of the Ministry of Internal Affairs. This means its reality. But if his data is not found, this is an alarming sign - either the patent was obtained illegally, or it is overdue. However, one should not rush to draw conclusions, but it is better to check the status of the patent application and find out all the circumstances in the migration authority itself.

What is required to obtain a patent

A labor migrant can become the owner of a coveted permit that allows him to officially work in a certain region in Russia only upon a personal visit and presentation of two documents:

  • passports;
  • receipt of advance payment for the patent.

How not to get scammed

Since the flow of labor migrants to our country from visa-free states does not dry out, the demand for patents is very high. Most visitors do not speak Russian well and are poorly versed in Russian legislation, so they often turn to intermediaries for help in obtaining a patent. And this is the most fertile ground for scammers. They take money from people, offer services for obtaining a patent, but give migrants a fake or disappear altogether with the money.

To avoid such troubles, it is best to contact a specialized institution. Do not forget about the existence of electronic patent verification services. Step-by-step instructions for their use have been presented above.
