With regard to capable passengers, clause 108 of FPA-82 obliges the passenger to independently determine the possibility of using air transport, based on the state of his health.

It should be borne in mind that self-determination of the state of one's health is an extremely subjective thing that does not take into account the behavior and physical capabilities of a person in a state of stress, which for many is a flight in a confined space for a certain time (often long). Also, various contraindications are possible, about which it is advisable to consult a doctor in advance, having received his recommendations regarding air transportation.

A categorical contraindication to the flight is a heart attack or heart surgery, unstable angina pectoris, insufficiently compensated heart failure, uncontrolled arrhythmias of the heart, transferred in the previous two weeks. You should also refrain from flying in case of absolute insulin deficiency, since constant administration of insulin is required, which is not always possible in air transport.

Also transportation of a person with disabilities may affect the safety of the flight, since in some cases it is required to carry without disconnecting life support equipment, which consumes a large load of electricity and sensors that transmit radio signals.

According to the Federal Law of the Russian Federation of June 7, 2013 N 124-FZ "On Amendments to the Air Code Russian Federation"Article 34 paragraph 10 provides that the requirements for equipment aircraft technical means and equipment ensuring the availability of aircraft for disabled passengers and the timing of such equipment are set by the Federal Air Transport Agency. At the same time, it is indicated that it is not allowed to refuse to transport passengers from among the disabled and other persons with disabilities due to the lack of special equipment.

When concluding a contract, a passenger from among the disabled and other persons with disabilities is obliged to inform the carrier or an authorized agent about his disabilities in order to ensure appropriate conditions for air transportation.

In addition, Art. 53 of the RF Civil Code provides for the mandatory training of aviation personnel civil aviation to serve passengers with disabilities and other persons with disabilities and the use of technical means and equipment. The timing and frequency of such training should be established by the Federal Air Transport Agency.

Notwithstanding the above, carriers may refuse to carry or continue carriage of persons whose carriage, due to their state of health, on the basis of established medical or other certification, requires special conditions of air carriage or threatens the safety of the passenger or other persons on board the aircraft. At the same time, according to article 107, clause 1, the burden of proving the existence of grounds for terminating the contract for the carriage of passengers by air lies with the carrier.

In particular, under special conditions of carriage, it is possible to accept those conditions that the carrier is not able to provide, for example, the absence of turbulence during flight, pressure drops, peculiarities of loading, stowage and unloading (which is often impossible due to the design of the aircraft or airport), etc. etc.

The air carriage of a disabled passenger and other persons with disabilities on a stretcher is carried out with prior notification of the carrier or the carrier's agent performing the booking, sale and clearance shipping documents, or a tour operator or travel agent about the need for transportation on a stretcher within the terms set by the carrier.

Air transportation of a disabled child under the age of twelve is carried out accompanied by a passenger assisting them in flight.

Medical control.

According to Art. 107 VC, disability and the presence of disabilities cannot be grounds for the carrier or an authorized agent to require documents from passengers with disabilities and other persons with disabilities, confirming the state of health of such passengers due to their disability or disabilities.

Medical control is not required for passengers with disabilities not listed below. No prior medical supervision by the carrier is required unless he decides otherwise or if he has special instructions from the carriers involved in the carriage.

In the event that the carrier in contact with passengers (or a person delegated by the passenger) receives information that such a passenger:

¾ suffers from a disease that the carrier considers to be actively contagious and transmitted to others, or

¾ due to a certain illness or disability, may behave in such a way or have such a physical condition that could adversely affect the health and well-being of other passengers and / or crew members, or

¾ requires medical attention and / or special equipment to maintain his health in flight, or

¾ his health may deteriorate during or after the flight.

Such a passenger must first obtain permission to fly by air from the medical authorities of all carriers participating in the carriage on the basis of information about the physical and mental condition of the patient, obtained by the medical service directly or through a certified specialist familiar with the condition of the passenger, and transferred to the carrier in contact with the passenger.

In order to obtain the consent of the other carrier, medical information must be provided and disclosed when requesting seats on that carrier's flight. If the carrier receiving the flight request has substantiated doubts about the passenger's illness / disability, he must request medical information for assessment and authorization. The carrier may refuse to transport a passenger who needs medical permission, but the passenger has not provided this permission.

Sick / Disabled Passenger Service Information - INCAD.

For the convenience of issuing a medical permit for travel by air (where required), the medical service of each carrier and to ensure a standard in air transportation procedures uses a standard form "Air transportation under special sanitary conditions" (INCAD).

The INCAD form or a similar form for servicing a specific carrier (printed on paper or displayed on the display of an automated system) is filled in two copies and consists of 3 parts.

Part I. To be completed by the agency / sales agent upon passenger contact. Contains all the information about the necessary assistance, the availability of escort and other features of transportation.

The form must be signed by the passenger himself or on his behalf if the second part of INCAD has been completed or if there are other requirements. The first part of the INCAD copy must be attached to the passenger's ticket.

When booking the carriage of a deaf or visually impaired passenger, this procedure is not used.

Part II. To be completed in cases where the carrier's medical services require a medical clearance to fly. To be completed by the attending physician, contains short description illness, position in flight, the need for special services (stretcher, wheelchair, medical vehicle, oxygen, vegetarian food, etc.).

The information contained in Part II is confidential. Based on these data, the patient receives permission from the carrier's medical services.

The completed INCAD form or a similar service form must be returned to the carrier's office in contact with the passenger in order to transfer the information to the automated air transportation information system for information of other carriers involved in the carriage of the passenger and obtain permission from the medical services of these carriers.

Part III. To be completed and signed by the passenger and contains the declaration the removal from the carrier of liability in case of deterioration of health due to the underlying disease and payment of all costs associated with the provision of additional services.

The Declaration Form is provided to the passenger or accompanying person by the carrier's representative or check-in agent service company during registration. The accompanying person has the right to sign the Declaration only if he is the next of kin or guardian of the passenger. If the passenger or the person accompanying him refuses to sign the specified Declaration, the passenger is not allowed for carriage.

Medical card of a passenger who frequently uses air travel. (FREMEC).

For the convenience of frequently flying sick / disabled passengers, the medical service of any carrier can issue a standard FREMEC passenger medical card. The provision of blanks for these cards is subject to the conditions of the issuing carrier.

If the cardholder presents it within the validity period, carriers must accept it as an authorization, with all the restrictions set forth therein, and as an identification of the holder's illness / disability. If a passenger requires special medical assistance or special services, the details in Part 1 of the INCAD form should be used as a means of communicating such claims.

It is only allowed to change the location of headings and columns, size and type of font. Standard map text should be on english language, (but translation into other languages \u200b\u200bis allowed) except for those places where generally recognized medical terms are used.

In the absence of a medical card (INCAD), a passenger of this category must undergo a medical examination at the airport by filling out the "Air carriage under special sanitary conditions" form. Service at the airport of departure.

In the ticket of a sick passenger / disabled person, after the surname, there must be the code “SP” - which means “special procedures”. Information on the presence of sick and disabled people on board the aircraft should be sent to the airports of transit, transfer and destination.

The number of people with disabilities who are ill transported on the carrier's flights may be limited.

Passengers with reduced mobility or disability must not be accommodated in rows located near emergency exits and in aisle seats, and must not be placed so that in case of an emergency, they leave the plane through emergency exits on the wing.

The operator or his authorized agent must ensure that the airport has facilities and services to meet the needs of the elderly and disabled, in particular wheelchairs and other means of transporting passengers, as well as the possibility of providing medical assistance. If a passenger using a wheelchair needs assistance in getting to the aircraft, the check-in agent contacts the unit responsible for providing such assistance.

When servicing passengers WCHS, WCHC (AIRIMP code system), equipment is used that allows them to be moved between the airport medical center and the aircraft, as well as to raise (lower) them directly into the aircraft cabin (special vehicle of the "medical car lift" type).

In accordance with the Technical Instructions for the Safe Transport of Dangerous Goods by Air, ICAO Doc. 9284 AN / 905: "With the permission of the operator, it is allowed to carry small cylinders with gaseous oxygen or air in the cabin of an aircraft, which are necessary solely to support the life of patients accompanied by medical personnel." In all other cases, oxygen cylinders are processed and transported by air as dangerous goods.

For the carriage of cylinders with gaseous oxygen or air in the cabin of an aircraft, which are necessary exclusively for ensuring the life of patients accompanied by medical personnel, the following requirements must be met:

1. Cylinders must have a certificate of completion of the inspection at the factory, indicating the period of validity of the certificate and cylinder numbers.

2. The number on the cylinder must match the entry on the certificate.

3. The cylinder must be properly packed to avoid its unintentional movement in the aircraft cabin.

4. The container must have the appropriate hazard marking: “Non-flammable gas, cl. hazard 2.2 ".

For each specific flight, the carriage of cylinders for a sick passenger must be agreed with the Carrier in advance.

The ship's captain / chief flight attendant must always be informed of the presence on board of sick passengers of all categories, their accompanying persons and any special measures taken for them.

When servicing at the airport of departure, the sick passenger is assisted in going through all the formalities before departure. The luggage of sick passengers is accepted for carriage according to general rules, with the exception of items necessary for sick passengers in flight and dogs accompanying blind passengers.

For sick and disabled people, medicines, a folding chair (wheelchair) carried in the cabin, crutches are transported free of charge and are not included in the norm free carriage luggage. Crutches are placed and secured in the immediate vicinity of the passenger in compliance with all placement requirements hand luggage in the aircraft cabin.

The boarding of sick passengers (disabled people) and their accompanying persons must be carried out before the boarding of other passengers.

Wheelchairs powered by electric batteries are accepted for carriage in accordance with the IATA and ICAO regulations on the carriage of dangerous goods. Batteries must be securely attached to the seat, disconnected and isolated beforehand to prevent short circuits. Power supplies must be marked accordingly. Liquid batteries are only transported in an upright position.

The organization of services for passengers in wheelchairs is carried out through the medical centers of airports, delivery to the aircraft and to the airport from the aircraft is carried out by special transport separately from other passengers.
